What do you make of Rep. Phil Hart's scrape with the IRS and state tax officials?

    Amazing what some folks will try in order to get out of paying their fair share. The IRS assessment is probably due to both penalties and interest and seems equitable to me. It sounds like Mr Hart is a fraud who has hoodwinked the unsuspecting into purchasing his book.

    Be good little citizens and do as the protective government tells you and pay your taxes. Do not question authority or we will deliver just and proper punishment. We only do these things for your good. We are protecting you from trouble makers who would question our system which is fair and just. You dont want these trouble makers running around would you?

    By the way, Jesus was against paying taxes. The part about rendering unto Ceaser was put into the bible by the establishment during the time of King James, same thing with the obey your master crap. Wake up you idiots quit drinking that kool aid and show some support for a true patriot and defender of freedom.

    Hmmmm, this doesn't make sense. The IRS has a lien on Phil Hart just because he won't turn over a list of everyone who in the past bought a book that he authored?! Is that it? Nothing else? Can the IRS legally do that?

    If all this is true, then the right of free speech and freedom of the press goes out the window if you're an author critical of the IRS, or any other bureaucracy. The right of free association is also potentially endangered for all those that bought Phil's books regardless whether or not you agree with him. Very bizarre.

    Come on folks, you all keep insisting that "poor" Phil is a victim of the IRS. That he has paid his due and "voluntarily" reentered the system. Railroaded - not enough time? He's been dodging taxes since the early 90's, at least that's when the IRS caught up with his shenanigans, and it's not just the IRS like some of you insist.

    "Hart, who has invoked his status as a state legislator to argue that he should be able to appeal an order to pay $53,000 in back state income taxes, penalties and interest despite having missed a filing deadline."

    Put the Kool Aide down and step away from the table. I'm sick of self serving politicians. I pay my taxes, not because I like the current system. I pay them because it's the law and it because it helps maintain social order in our society. Phil is not a do gooder; he needs to get on board the fastest railroad to resignation we can find.

    This is a complete and total railroad job by the IRS.

    Phil Hart did write a book challenging the legality of the federal income tax system as now administered and has also sponsored a bill to end the Idaho state income tax (also explicitly prohibited by the Idaho state constitution which limits taxation to property--which income is SPECIFICALLY NOT under Idaho law). However, these tax liens are NOT from him not filing or paying the taxes he really owes. Phil Hart voluntarily re-entered the system as a filer, filed his past returns, and paid his tax liabilities. However, the IRS wants revenge on anyone who stands up to them, so what do they do -- they then instigate and audit of EIGHT years of tax returns which lasted for FOUR years. In the process they tried to get Phil to release the names and addresses of EVERY person who bought one of his books, which he refused to do. Ultimately, they ARBITRARILY COMPLETELY DISALLOWED ALL OF HIS BUSINESS EXPENSES. This would be like paying $100 for an item and selling it at a $125 price retail, and pocketing a $25 and the IRS arbitrarily saying that the $100 costs do not count and the person owes taxes on the full $125! There are multiple reports of the IRS maliciously doing this to many people across the country, which SHOULD HAVE been the real story behind these reports.

    The IRS sent Phil a Notice of Deficiency while he was in legislative session. Under the Constitution of Idaho, such a notice would be invalid while the legislature was in session, a prerogative which Phil told me the IRS has adhered to in the past when it was brought up. This time, they just ignored it. As a result, Phil was unable to file a timely notice of challenge of the unlawful assessment in Tax Court, and he was completely RAILROADED through the system. After the expired notice of deficiency went unchallenged the IRS was able to file the liens which are in the press. By the way, the NOD process the IRS commonly uses is in my opinion (and anyone else with common sense) a complete and total rejection of due process and can be considered a bill of pains and penalties (the personal property adjunct to a bill of attainder) since it allows the seizure of property WITHOUT ANY JUDICIAL REVIEW OR COURT HEARING WHATSOEVER BY DEFAULT. If you do not explicitly ask for due process in a very limited amount of time, you DO NOT GET IT! Did you think only the Soviet Union allowed people to be by default declared guilty without a hearing -- well welcome to the USSA!

    A word of caution to all who would attach the noose. How typical of the average naive citizen to hang the very one who stuck his neck out to defend them and how convenient of the establishment to arrange for a hanging to eliminate the one who is sounding the alarm. Better consider your actions and get some facts.

    If I'm not mistaken, Phil Hart has filed and paid all his back taxes. The issue at hand is that unless he turns over the names of everyone who bought his book, the IRS isn't recognizing the publishing costs as a valid business expense, and expecting him to pay taxes and penalties on these "profits". He hasn't evaded any taxes, the IRS just wants him to turn over his customer list...

    Anyone that still believes that IRS conducts its affairs ethically and lawfully does not deserve to be known as an American. The mafia has more honor than this rogue agency that is nothing more than thugs operating under the color of law. The IRS code of conduct is based on fear, intimidation, force, and usurpation of authority -- all designed to break the will of any citizen bold enough to challenge their evil, parasitic, freedom-destroying cabal.

    WOW! The Poll ain't going so well for Phil Hart. I wonder what Phil's friends in the Idaho House think of this brouhaha?

    In times like this we need to ask ourselves WHAT WOULD JESUS DO? :) Hahahaha, just kidding.....Jesus would say pay the piper and be done with it. Ron Paul would say it's OUR responsibility to face the consequences if we decide to cheat on our taxes and get caught in the process.

    Pay up and face the consequences Mr. Hart.

    This audit is pretty much a sour grapes attack on Phil Hart by the Establishment Republicans and IRS. That's what happens when someone has the guts to take a stand against tyranny. Our prayers are with Phil.

    We need more people like Phil Hart to take a stand against the IRS. Most people do not understand that there is no law saying you have to pay income taxes. The tax system was created to tax on profits, ie corporations etc. We as rule do not make profits as workers, but rather trade our hours for dollars. Another misnomer people have is our country needs these tax dollars to function. Almost all of our tax dollars go to pay interest to the federal reserve for "loaning" us the money they print. We all need to stand behind Phil in his fight and would be better if we all joined him is depriving the fed of this money that feeds it.
