I firmly believe dolphins and whales (and all other animals) need strengthened animal rights, but to consider them persons under the law? Not the best course of action in my opinion.
If animals are afforded the same rights as humans, what happens when an animal commits a crime? When an animal is the victim of a crime? Do these animals have the right to face their accuser? Do they have the right to a fair trial? How do you try a lion fairly? Can a gazelle understand their rights when arrested? Do we have to offer an otter service in two languages? Do we try a coyote for murder if it hunts a deer for food? Do we charge a vulture with desecrating a body?
It's one thing to have a nice lofty ideal that translates nicely into a 30 second sound bite for the news. But to give human rights to animals would be impossible to do practically. I don't know about you, but I don't want to chase down every chickadee to ensure they have access to clean drinking water.
The issue here is anthropomorphizing animals and the belief that nature is cruel when viewed from a human perspective.
I have seen people leave out bird feed for migratory birds well past the time to fly south. I have also seen these birds covered in ice and hardly able to move, since they stayed in a climate they are ill-equipped to handle due to a readily available food source.
I have seen people break down in tears thinking about how cold that poor raccoon must be in the winter. I have also seen said raccoon fattened up and sleeping comfortably all winter long.
A lion is not going to consider your rights when it feels you are a danger, it's going to rip you to shreds.

Yes, there are even some like myself who believe these beings have intelligence far beyond mans. Socially they leave us back in the Cave man days. Dolphins are not sentient or sapient on anywhere near the same level as humans. They’re about as smart as rats or pigs. Now, that isn’t to say that dolphins are especially dumb, just that there are plenty of other animals that are pretty smart.
Why should we give human rights to cetaceans before we give them to rats and pigs?
The question of whether dolphins and whales deserve human rights has less to do with their intelligence that it does with how modern Western society has made ‘sacred cows’ out of them.

I think all humans in the world should have human rights,but animals also should have rights in this world because thats the only way that they can be protected from poachers,hunters, skinners of animals for fur and protection from abuse in farms and slaughterhouses,this is the only way that animals will have voices to protect them from violence and be treated as victims from humans who can be prisoned for certain acts against animals including buggery and rape torture and murderous acts and dog fighting..

Dolphins are not sentient or sapient on anywhere near the same level as humans. They’re about as smart as rats or pigs. Now, that isn’t to say that dolphins are especially dumb, just that there are plenty of other animals that are pretty smart.
Why should we give human rights to cetaceans before we give them to rats and pigs?
The question of whether dolphins and whales deserve human rights has less to do with their intelligence that it does with how modern Western society has made ‘sacred cows’ out of them.
As soon as the rest of the animal kingdom becomes herbivores, then I too, will become a herbivore.

I think all humans in the world should have human rights,but animals also should have rights in this world because thats the only way that they can be protected from poachers,hunters, skinners of animals for fur and protection from abuse in farms and slaughterhouses,this is the only way that animals will have voices to protect them from violence and be treated as victims from humans who can be prisoned for certain acts against animals including buggery and rape torture and murderous acts and dog fighting..
People seem to be confusing the words 'human' and 'person'. No one is suggesting we give cetaceans 'human' rights. The idea of 'personhood' is what is being talked about here. Please note the difference between the two!
How sad is it when we give human rights to animals, but we take them away from human fetuses because it's inconvenient for us.
