Should Kyle Best's girlfriend be included in the lawsuit because she was texting him?

Interesting topic. It does not seem to me that the attorney who included the girl sending the texts did it for added financial gain for the victims of this horrible accident. I doubt there is substantial money to be obtained from either the driver of the car, or the girl doing the texting. However, he has gained almost instant notoriety. Priceless for an attorney swimming in the cesspool of injury attorneys. (no disrespect to the victims who hired him).
It seems pretty clear to me. The driver of the car did not have to text back, or for that matter even read her incoming texts while driving the vehicle. If they were of an urgent nature he should have pulled over to deal with them. I receive texts all the time while I am in my car.
Never in a million years would I try to read them while driving. I also believe age is a factor here. The driver was 18? I wish we do in the U.S. what is done in the Netherlands, (I believe, could be some other country). Kids are required to pass their driving tests WHILE texting. They can't do it. It is that country's was of showing new drivers the real danger of this practic.
