Should the sender of a text message to a person driving be held liable in the case of a texting-while-driving accident?

    I agree with the other two people who left comments. The recipient of the text has a choice to make. (A) wait to look at the text when it is safe to do so or (B) look at the text and repond immediately and run the risk of an accident to self or others. Just because a person sends a text to someone, how can they be held accountable to the recipient choosing when to look at or respond to that text?

    When you are texting someone you have no Idea of what they are doing,. It's just like Att free messages, they dont no what am doing, its up to me if I want to read that message. Some ppl think that they can do it all drive, talk , text and read text and dont understand the Consequence.

    She may not have even known that he was driving at the time. I send text messages all the time, I never ask what the person is doing before I send it. It's horrible that this happened but the man should have ignored his phone until he was parked somewhere. Looking at the text/texting back was his choice.
