This is a futile argument. Whether the publication of such photos is merely in poor taste or actually illegal is irrelevant. Cameras are ubiquitous and the Internet has global reach. Privacy will ultimately only be available by default for those whose life is of no public interest. Should Leveson throttle the British press he will hasten this eventuality. Perhaps 'celebrity' status will no longer be so eagerly sought.

People you seem to be missing the point yes it was a terrible invasion of her privacy but she is not just any ordinary woman she will be QUEEN one day she should never have went topless in the first place she knows that every chance the paparazzi get they will be snapping her photo so its her own fault.It wasn't so long ago her Mother was going off her rocker because family holiday snaps had been published why i have no idea her mother is getting above her station its her daughter that's royalty now not her,i wonder what mummy dearest thinks about these photos?. I feel sorry for all the young members of the royal family as they cant do things like go topless or party in Vegas there meant to show an example sadly that's proving hard for them to do.

This is a terrible invasion of privacy, it is such a shame that scummy paparazzi should do such a thing and it is utterly unacceptable that a magazine should decide to publish them. The editor who green-lit the publishing of these pictures needs to be punished in the most sever terms.

I think it is appalling that you should even consider the question. Any decent person can only regard this as an assault on the Duchess of Cambridge and by toying with the issue you are complicit in what should be a matter for the criminal courts.

You should absolutely be able to, but it seems to be an invasion of reasonably expected privacy and not at all in the public interest to publish these photos.
