In order to understand patenting of government discoveries you need to understand the Bayh-Dole Act. For many years these discoveries were not patented. The problem with this was that no commercial entity will invest large sums to move such discoveries to the marketplace, only to have others jump in and take the bulk of the profits. In that situation, such discoveries are never commercialized.
