Do you think Canada should have a fetal homicide law?

    Yes, Canada should have a fetal homicide law. We are the only country & democracy not to have such a law in place. There should be a law or at the very least an amendment made to the law(s) and or current criminal code to address this issue and issues similar to it. Cassandra and Molly were brutally murdered in their home. Their death has nothing to with abortions period, as she wanted her child, was expecting to give birth to her child and had every legal and human right to do so. Making 3rd party perpetrators such as in this case who harm and or commit heinous act(s) of crime(s) against a pregnant woman should be held accountable under the criminal code, no if's ands or buts. There should be something clearly and visibly written into the criminal code that states accountability when murdering a pregnant woman during act(s) of crime. There needs to be more than just hearsay/words/conversation etc.. that judges have the power to take extenuating circumstances such as this murder into account when sentencing. What if some judges don't ? There needs to be something written and clearly written in the law(s) that says that they are mandated by law to do so! It needs to be a law that carries with it many many years of prison.Specially when and if a perpetrator knows the woman is pregnant. There is nothing in our current law(s) and the criminal code in Canada that protects a pregnant woman such as Cassandra and her right as not only a woman, but as a human being, to be pregnant and carry her child to full term. That is wrong on so many levels. Anyone at all who is even one iota pro-choice and or supports women's rights etc... should be screaming,defending and being Cassandra Kaake's voice and that of her daughter Molly's in this matter, as her choice as a woman in this country to carry her baby Molly to full term was brutally taken away. Molly would have grown up to be a woman too one day by the way. A productive member of society. But a 3rd party criminal seen to it that, that will never ever happen.

    When you have an expectant mother who is 31 week along and joyfully expecting the greatest joy of her life and both her life and her child's life are brutally ended, Yes there should be a law to protect mother and child. Since Cassies and Molly's Murders I have seen more empathy for the criminal than I have for the innocent victims of these horrendous unforgivable crime. If you do not experience some one you love having suffered greatly at the hand of a monster you will never understand( if you vote NO ) Those who vote yes are cognizant that this was a violent criminal act. R.I.P. Dear sweet Cassie and Molly and all the other Mothers and babies who have lost THEIR RIGHT TO LIVE.

    We kill children...and we say BRAVOOO!!!! We kill dogs and we will end up in jail...(and I have nothing against dogs so don't get all twisted on me)...it's just to make a point

    Let's inject some rationality into this debate. What would this law change?

    A 1st degree murder conviction carries a life sentence, no parole for a minimum of 25 years. Like it or not, a second conviction would not carry a significantly longer sentence, especially given the aggravating factors that make this case so awful. The creep who did this will be behind bars for life without the existence of a fetal homicide law.

    So what do advocates of this law hope to accomplish?

    Look at the groups and MPs supporting it and you will see overwhelmingly that these are anti-abortionists. It's safe to assume that instead of wanting to punish the guilty or provide protection to the wanted unborn fetus (current law provides for both by protecting a woman, pregnant or otherwise) this is a callous attempt to use a tragedy for political ends, to re-open the abortion debate. That debate is closed, the courts have ruled, your side lost. Have the decency not to leverage a tragedy for your political ends.

    Two women in the states have been jailed for having miscarriages, so don't say it wouldn't happen.

    Even with the whole then women couldn't get an abortion they could even do ITT so once past the legal time for abortion fetal law can take place and this women was

    Even this anti-choice group recognizes the arguments that such legislation can criminalize pregnancy and has done so in many US states.

    We don't need this law. We have enhanced sentencing guidelines for just this sort of situation.

    I cant believe people would vote no on this. If its cold hearted, women right activists that votes no then who speaks for the unborn child? Personally, abortions should be next to be eliminated as you should be responsible enough to keep your legs closed or use protection instead of deciding to murder a baby your decisions have created. Too many selfish people in this world. Its no different than what isis does to people except you cant hear the babies cry inside.

    In the US they have laws distinguishing both sides of this issue; those for pro choice and those to protect the pre born who ARE wanted. They speak English as we do. Why can't our law makers find the right words to do the same. I am so deeply disappointed in our law makers . Put yourselves in our shoes. What would you feel if this were your wife and child, daughter, sister or grandchild; I'd like to believe you could all empathise. Do the right thing. Find the right words. Protect EVERYONE including the preborn.
    I am so broken hearted and profoundly disappointed!!!

    I think that Megan takes it to far. Saying that a woman will have fewer rights is wrong. No mother will be charged for having a miscarriage come on! It's not like people in grade school make the laws. They would be clearly defined. I can almost guarantee it would state that if a woman who is x amount of time pregnant than the person who murdered said woman would also be charged for the murder of said baby. I don't see how that relates to a miscarriage in anyway.

    When is the last time this law has been updated? Technology has advanced and babies have been know to survive fairly early already and if they can live on there own why are they still being called fetuses? This law needs a major update.

    The law should be in place for a viable pregnancy. A viable pregnancy is when the baby is able to be delivered and have a chance to survive . ( eg: only ) 6 to 9 months of pregnancy) Advocates for abortion rights usually opt for an abortion before 4 months. If there is no clear language on this topic, It will never pass into law.I personally do not believe in abortion but to accomplish some some kind of safety net for our viable babies ,unfortunately we have to compromise

    If it is not considered a live person until it comes out of the womb, why bother going to doctors, why have ultrasounds? It has a heartbeat, it moves. It has a head, body, arms, legs, fingers and toes! Whether it dies in a car accident, or by a brutal, savage murderer, it is still a live human being. You can see it on an ultrasound, you can feel it moving, you can even hear it's heartbeat. Just because you cannot see it outside the persons body yet does not mean that it is not a live human being inside. You kill the mother, YOU kill the child!!!!!!!! and should be charged for both!!!!!!!!!!!

    carry a gun immediate 2 years in jail passed a few years back what happened to that . a minor doeing murder? 2 yerars in a juvy home 4 years probation .out on the street . automobile accident mom and unborn baby killed . vehihicular manslaughter for two counts 5 years . hey did i forget . vehicular manslaughter 2 counts . wow what is the differance between the 2 cases both 2 count charges but you have to drive a car for 1 to be admissable , this government of ours sucks big time . and the lawers get richer , and familys involved get tears (not for the accussed , they get high fives) and walk . same will happen in this case upcomming if they passed this law . the same type of case would have to involve a high up government person who can stroke that pen . we are wasting our time . also in other words abortions are not murder as peaple say it is . point made but nothing is going to happen .and life will go on until we read of another .like the other

    Prematurely born babies beat the odds every day, some born as small as 1 1/2 pounds. The criminal code should be brought up to date. Baby Molly would have survived and early birth in different circumstances. But just because she was not 'born' does not mean she should not be recognized as a life. Baby Molly was a living human being.

    Mom of three and PROUD no voter. Fetal homicide laws are a hugely bad idea. That ends up with women having fewer rights than a corpse and risking jail time for miscarriages.

    Who ever is voting no is cold hearted and never had a baby or ever seen an untrained or felt an baby grow inside of u ! This vote in a no brainer everyone should be saying YES!!!
