Can I legally cut that down?

Legally you can't cut it down. But you can trim your side. Especially if it's disturbing your personal effects. There's nothing your neighbor can do. And also the tree lives by its roots. Not by the canopy. And 800.00 for a tree trim is a little steep. You want to trim the tree not cut it down. Hope this helps. Good luck!!

Is there a power line above the tree? If so, call HL&P and tell them that the branches are striking the power line during thunderstorms--they'll come and trim it for free! Then you can also cut off the stuff on your side... And blame it on HL&P if the new owners don't like it ????

If you cut your side it won't affect the tree on whether it lives or dies. It lives through its roots not its canopy. Good luck!
