    Why aren't the opponents to a statewide law prohibiting smoking in public places complaing about other health regulations in effect there? There are many "legal products" that can't be used everywhere. Guns are an example. They are legal but you can't use them in a bar or restaurant. Secondhand smoke kills and it isn't always possible to avoid businesses where smoking is permitted.

    Johnny, the difference in the situation you talked about and this current situation is that if a person wants to be large, eat fatty foods, and drink to oblivian, that is their right and it, for the most part, doesn't infringe on my right tpo enter an establish that supports the health and welfare of all. Although, I do not believe the government should be dictating how a business should conduct itself, I do believe that the right of a safe and family friendly enviroment is my right.

    This is a slippery issue. but to bring a point more to the light, it isn't legal to drink and drive, it isn't legal to impose yourself on someone, unwantingly, in a drunken state. And it sure isnt legal for minors to drink.

    A smoking section inside a building is like having a pissing section inside a swimming pool. The effects of "second hand smoke" have been well documented for many years. Smoking should be banned inside businesses that are family friendly like restaurants,entertainment, retail and all public transportation.

    I do not support a smoking ban in adult only business like bars. At least 2 bars in Topeka that I know of have gone smoke free.

    Adults can choose whether to patronize bars that allow smoking or not. But
    children are forced to deal with the parents choice where to eat, go bowling,ride in a city bus or a taxi cab, etc. There are many parents that choose to smoke around their children. But at least when they are away from there parents they will be able to breathe clean air and hopefully extend their lives a little bit longer each time.

    Perhaps the KDHE or the USDA should create an 'air safety' division if the argument is the government has other codes and regulations. To my knowledge there is no such regulation.
    Also, what about people who smoke in their homes and cars with kids as a captive audience? They are endangering those children. But since it's not you I guess it doesn't matter.
    I get the whole public safety argument, but allowing the government to ban a legal substance in private business is a slippery slope. Just take some personal initiative and don't spend your money in those establishments with less-than-pristine air.

    Okay, when are we going to ban alcohol or fatty starcy foods. Obesity is killing people, alcohol is killing people and causing Hopital stays also. Where do we stop trying to enforce some peoples views on others. If you don't like the smoke don't patronize the estabilishment. I know people who complain all about smoking until they go to a club and then they are smoking also. Get real, it is up to the individual and should not be a state or federal concern.

    SINCE THERE ARE NO GOOD OUTCOMES FROM ANY FORM OF TOBACCO USE, I WOULD SUPPORT BANNING THE SALE OF ALL TOBACCO PRODUCTS. THE TOBACCO COMPANIES ARE BEING SUED BY 8000 PEOPLE IN THE STATE OF FLORIDA ALONE. SO FAR PLAINTIFFS HAVE WON 7 DECISIONS, TOBACCO HAS WON 2. AT THIS RATE, THE TOBACCO COMPANIES WILL ALL BE BROKE IN 10 YEARS. TOBACCO CONSUMPTION IS AT IT'S LOWEST RATE IN 29 YEARS.
    AS FOR BUSINESS CONTROLS, I AM PERSONALLY GLAD THAT WE HAVE SAFETY CODES, BUILDING CODES, ZONING LAWS, FOOD HANDLING AND STORAGE CODES, WAGE AND HOUR LAWS, ETC. WHEN A BUSINESS DECIDES TO OPEN, THEY AUTOMATICALLY FALL UNDER THE JURISDICTION OF ALL THE ABOVE TO PROMOTE AND PRESERVE THE GENERAL WELFARE OF THE COMMUNITY. WE DON'T TOLERATE TAINTED FOOD, OR TAINTED WATER, NOR SHOULD WE HAVE TO TOLERATE TOXIC AIR.

    We've banned many carcinogens already. We need to keep going until they are all banned or seriously curbed. The only problem with smoking is that there are people who're addicted to it. Nobody is addicted to DDT, so that's an easy one to figure out. Smoking may have to be banned slowly. Therefore, I agree that it should be banned in all public places, but not outlawed yet. However, in time, it should be both banned and outlawed. That would give businesses time to adjust or find another product to sell.

    My problem with this is the definition of a "public place'". In my view, any private buisiness should not have policy regarding a legal behaviour forced onto them against they're will. Let the owners decide. If ypu do not like they're policy, go elsewhere. No one is forcing anyone to patronize, or seek employment in an atmosphere they so strongly dislike.
