the Planning & Zoning Commissioners (at their June 14th, 2012 meeting) voted Positano's proposal DOWN 6-0 !!! They had all the information available to them to make an INFORMED decision.

Heck yes! We have been saying for 11 years..."how on earth can you not eat outside at that location"? Give me a break, noise! How noisy are ten adults eating dinner 50 feet away from your house?

from "Westport Town Regulations and Restrictions:
    1. Pop-ups are only allowed in the BCD and BCD/H zones."

*Many of the restaurants that are adding 'pop up' outdoor dining do not own the sidewalk and Westport is allowing them to do it. The reasoning seems inconsistent.

*Elviras already has outdoor picnic tables and the people who can afford to eat at Positano's are an older, quieter group.

It would enhance the area to have outdoor dining at Positano's.

I think that only the people who live in the immediate area, who might be affected by the change have the reason to care and vote.

No way! You can't reward illegal activity. This is like the guy who murders his parents, and asks the court for mercy because he's an orphan.
    Are you kidding?

THE POLL QUESTION ABOVE IS GROSSLY INACCURATE ....The question before P&Z wass ..."SHOULD POSITANO BE ALLOWED TO LEASE TOWN BEACH PROPERTY FOR OUTDOOR DINING"..The patio does NOT belong to POSITANO's and was built without permission illegally. THE OTHER IMPORTANT QUESTION BEFORE P&Z WAS: "Should Positano be allowed a prohibited commercial use in a residential zone?" THOSE ARE THE QUESTIONS !!!! Truth in journalism , please ......

There is no doubt that having another outdoor dining option on the water would be great! Outdoor dining at Positano would be wonderful and certainly add to the charm of the beach area. However, they should have done it the right way, through proper permits. It seems there is plenty of property on the side of the restaurant to be utilized.
