Do you think hate crime charges are appropriate in this case?

I have seen where native peoples in Calgary are constantly spat on and called down. I sat and talked with two natives who were highly intoxicated. I sat and talked with them as I seen person approach them in native degree. I seen city police looking on. I then left to do some thing, upon my return I saw two city police standing about ten feet away from the now native man who passed out. I young white women dressed as like a skin head was sort of jumping around and going towards the native man all the while the cops looked on and said nothing, literally letting this young girl approach the man passed out and hit him say derogatory things and spat on he. She was running towards the man again when she seen me approach, she stooped and looked at me and at the cops. I approached the man passed out now wondering if he was in fact knocked out because of his intoxicated state. As the young girl also had two guys with her. I take it the two men knocked him around, and the girl tried to chime in but she seen me. I stood in between the police and the man. I approached the man and saw he was obviously hit some how and the spit, which was a lot. I turned to the police and said why did you allow this. I went to the man and could not wake him. Now assuming he was in fact knocked out as I was not gone long enough for him to pass out. I also notice a lot of East Indian cab drivers are very racist against native peoples. So what this woman done was minor to what happens to the native peoples so why not protect the natives who are most venerable to attacks, and just just verbal attacks.

A "hate" crime is when a woman gets viciously murdered, like the woman in Edmonton who was recently murdered by a man who sure doesn't look like he was born in Canada.

As for the woman in the cab, why are we only shown part of the video? It's obviously in media res. There was obviously words exchanged prior to the point the video (we get presented to us as the beginning) starts. What was said to the woman by the cab driver? This country needs to focus on REAL crimes instead of politically incorrect "crimes". People are getting raped and murdered by scum of the earth who don't belong in Canada. Worry about them not some woman in a cab.

I'm very pleased to see this woman is going to be held accountable for such horrible vicious behavior! It was disgusting to witness!

Hang on.. that cop had an accent!!.. Burn him!!!!... Sorry, I'm still laughing at someone called Hardeep saying there are too many immigrants here.. The only smart thing this girl has done is keep her mouth shut since this story broke - might be an idea for some of the rest of y'all..

  • Hagar - 9 years ago

It is reprehensible behavior but not a hate crime. This is just another PC witch hunt. Most of the commenters on here are just using this as a platform for their own trumped up righteous indignation so they can feel good about themselves. She's an ignorant idiot for sure. Leave it at that.

Let's be clear about this, people like this (girl) a absolute scum. This Taxi driver left everything he knew, friends, family, neighbours and way of life, to come to Canada for a chance at a better future.

He filed papers, paid fees, served his time on waiting lists, completed interviews, took a number of tests and most likely worked crap jobs the entire time only barely scraping by so he could become Canadian.

And what did this girl do? Well she happened to get popped out of her mom in a particular geographic location. He's WAY more Canadian than she'll ever be.

  • Hardeep Chander - 9 years ago

This is what happens when people's frustration with too many immigrants boils over. We have had enough.

  • GIL - 9 years ago

your family name is Bachinsky? this is a Polish family name. you were probably just born here, but you're not a true Canadian. your family is also from other country. shame on you.

  • jim - 9 years ago

HARPER IBRAHIM. Don't follow your twisted logic. Yes this is discusting and below moral and ethically acceptable standards. But what is wrong with being a fisherman? it is just as respectable as any occupation. I am not one by the way but a retired engineer and former executive. I find you comments trash. ...period

Being drunk is NEVER an excuse!! I know the nicest people that remain nice even when they have been drinking! A person's true self is what comes to the surface after a few drinks!!

  • Lisa - 9 years ago

Unless she is from the aboriginal community, how can she even say this to anyone else??
If that's what she believes, she needs to go back to her ancestors country too and get out of Canada!!
    The faster, the better!!

Oh and by the way Hayder Ibrahim. Since I find myself in the ignorant, uneducated, knuckle dragging minority of the 12 per cent you mention let me say this. " she should be shamed, lose her job, her friends & her home " Really ? With a fair balanced approach like that I can tell you must be highly educated. Why not just bury her in the sand up to her neck and stone her to death ? Maybe a name change to Hater Ibrahim would be more in keeping with your values.

For those of you in the majority who have posted so far this may come as a shock. An overwhelming majority of people once believed the earth was flat and ridiculed those who did not. But of course the majority was ultimately proven to be wrong. So for those of you ( Lisa & Jeremy ) who can't fathom that there are 11 per cent who don't believe this is a hate crime I will say this. Calling somebody a name, hurling insults or otherwise hurting their feelings is rude, reprehensible & unacceptable. But I don't believe it constitutes a crime let alone a hate crime. That is why in the earlier case the police investigated but did not and still have not laid charges. You don't lay charges if no law has been broken & you have no chance of a conviction. For all of you lighting your hair on fire over this perhaps you could name the specific law you feel has been broken. This may be a verbal assault but can the crown get a conviction in this case ? Maybe maybe not . But a hate crime punishable by up to 5 years in prison ! And the self righteous lot of you would also demand she lose her job and be unable to be gainfully employed for the rest of her life. Sorry but we don't hand out sentences that stiff to rapists or other similar pieces of garbage. Beating someone up because of their religion or sexual orientation - that's a hate crime. Defacing a synagogue or mosque or burning down a church - that's a hate crime. Calling someone a name and hurting their feelings - that's not a hate crime. So that's my opinion & that's why I voted No. Now the irony is that the Holier Than Thou crowd who is in the majority here will freak out on me and call me all sorts of names after reading this. Be careful though because your speech may offend me to the point that I run to the police and seek to have you charged with a hate crime.

You know what is really sad.. is that this girl who is just ignorant and should be sent to a poor area to do community service and educated people for her prob drunken ignorant foolishness will get more jail time and media attention that the disgusting man Cody Paul Lemay who raped and damaged a 13 month old gets 5 years!! and is now walking around free.... Honestly News people start going after stories like that instead. Read it here http://www.hellbeasts.com/?p=2001

  • Lisa - 9 years ago

What made my jaw drop was how sweet and innocent Brittany looks in a picture of her (not the one in the cab). I hope that as well as facing charges she is completely embarrassed but I doubt it. I remember a time when Ukranians and Polish people were the brunt of many jokes though nothing this hateful (though she may only have the name by marriage).

As for Lyn's comment that doesn't surprise me at all. There is so much hatred in our world today. Sorry you had to endure that.

  • Janice - 9 years ago

Make an example of her and charge all of them to the fullest extent of the law. It's sad that we live at a time that anyone believes this is acceptable behavior. Everyone has the right to be respected regardless of age, race, religion or gender. Being drunk is no excuse. If you're that drunk that you can allow yourself to behave like this then it's time to sober up. The ramifications of this will affect the rest of her life. Maybe she will learn and be a better person for it. If not at least this may make others take heed and behave more appropriately.

  • Wendy - 9 years ago

Nolan - your derogatory comment about Americans is rude and unbecoming - practise what you preach. Debbie if you have witnessed or have tape of these kinds comments being levelled against Canadian aboriginals, do something - or you are part of the problem. The guy from Airdie lost his job and I hope this ugly mouthed woman loses hers too.

  • Lyn - 9 years ago

This goes both way. I'm a visible minority and I got verbally abused by a Black Top cab driver while crossing the street on the cross-walk at the North side of the UBC campus. I was already in the crosswalk and the driver wasn't stopping , so I put my hand out. That's when the the verbal abused on my gender and race-colour started. There were other pedestrians walking, but he took his anger out on me. I was in such a shock that my response to him was buzz off. One of the pedestrians, said to ignore him as he's probably having a stressful day. I am annoyed at myself as I didn't get his cab number. He started swearing at me and using derogatory comments about my gender and his hand gesture. Should I have pulled out my phone and start filming? It was such a shock that I didn't think of it at the time, then I too would have had evidence. This happened yesterday (Aug 26th) and it is very upsetting and makes me very angry.

  • Lisa - 9 years ago

To the person who thought all the cab driver needed to do was kick them out of his cab, think again! How do you think these drunks would respond to that?? It's not for the money that Cab drivers don't kick them out. In both cases the driver's acted with courtesy. I hope to hear that charges have been laid in the Airdrie case real soon. If you don't think these are hate crimes then you are part of the problem.

  • Michael Smith - 9 years ago

This issue involving cabbies needs to be dealt with in a serious manner and to the fullest extent of the law, but one question I have still is why hasn't the person in the first news story been charged as well?? or is it being swept under the carpet in hopes that the focus of this case goes to the others in the second video?
I mean come on people, the first cabbie should have his case dealt with in the same fashion.
He was un comfortable with coming out with the story in the first place but he did it in the hopes that someone be held accountable for his actions, and I don't blame him one bit about his frustration throughout the whole situation.....he deserves justice as much as the other cabbie .... maybe more so.

  • Robert - 9 years ago

How would she like to have to do his job, and be subjected to people like her?
The guy was just trying to do his job.

  • Sandra - 9 years ago

Yes absolutely this is a hate crime, no individual should be treated like that regardless of your race, colour or gender. That's sick those people who abused that cab driver have no morals and should be embarrassed to call them selfs a Canadian.

  • Les - 9 years ago

What about the 2 males who sat there and did nothing to quiet the white trash woman? She's lucky to have been born in our country, appreciate what a privilege that it is. If you don't respect its values, maybe she should leave. A refugee camp or possibly a slum in India would smarten her up.

  • Jeremy - 9 years ago

I'd like to know who the 11% of people are who think this is not a chargeable offense? Pretty sad.

  • Burgers - 9 years ago

I find it funny and sad that these videos are of nothing but drunk people. Do people forget what alcohol does to a persons judgement? Does it excuse it? No. But think of it logically now. These are all drunk people so far, and 95% of all cab drivers are of a different ethnic group(not race because technically speaking there is only one race in our society and many ethnic groups.)

What I find entertaining is the "White Knights" of the internet that are "fuck yeah!" or "WTF bigot/racist/blah blah blah."

Here's something interesting that you should think about fully. What leads us to so much hate towards one another? Give up? Media does all forms of it. Who buys all this "Drama"? We do. So why can't people just stop the car/cab whatever and kick them out? Oh yeah that's right because they would rather continue to drive the person to get more money then turn around and say woe is me. Woe is not you. You have a choice to kick them out and stop the behavior or continue on enduring the behavior.

If it were me. I would kick them out and go on about my business. Plain and simple solution, or find a better job.

  • Hayder Ibrahim - 9 years ago

Not only is racism still an issue with the low-class, ignorant pockets of trash located around Canada, but almost 12% of those who responded to the poll of this article think that it not appropriate to charge this racist scumbag for her actions, and the video clearly shows she deserves it. Attitudes need to change, and that means people need to be named, shamed, lose their jobs, homes and friends. Brittany Bachinsky should move to the maritimes and work as a fisherman, that would be most fitting

  • Janet - 9 years ago

Is it possible for cab drivers to have some way to send out an alarm to the police? It would be great to have a couple cop cars pull the cab over and haul those people to jail with the evidence right then!!!

  • Brittany - 9 years ago

First ..Mel , i'm so sorry for your hardships... please know that not all of us would ever be so ignorant towards you and your family.. Second of all for Canada being Ms. Bachinsky's country.. she should know better!!!! shame on her and her friends for treating anyone on this planet with anything but respect... as far as her freedom of speech goes... i would encourage her to reveal who her accomplices were; it would be a good start to showing her obvious regret of her own ignorance. we are all equal and have made mistakes ... but attacking another person for any kind of difference that is not hurting anyone else... is in my opinion the lesser of a human in any situation... ITS 2015 !! i feel i could go on and on..but i wont...

  • Les - 9 years ago

Yes I agree the people shown in the videos are lacking in judgement and may very well be bigots and or racist...the courts not social media should decide based on full disclosure of evidence. What gets me is I remember not long ago a white single mother with 4 kids got run out of a Calgary housing site by a group of Africans that live in the same site. This made the Calgary Sun. The mother had to leave Calgary for a while after trying to make some sort of amends with the community. My question to Global is: Why wasn't that family given the same coverage as the 2 cabbies?

  • Nolan - 9 years ago

Canadians should stop acting like Americans lol, it's not a good look for us.

  • Debbie - 9 years ago

There is also a group of people that hate crimes are directed at continuously and that is our Native population. Not once have I heard or seen a charge of hate crime against anyone for their racial slurs and violent acts toward these First Nations People. And why is that? To me, this shows that it is acceptable to treat and say things about the First Nations and get away with it.

  • Mel - 9 years ago

I am so glad that there are now laws to protect victims of hate and discrimination. When our family immigrated to Canada in the 70's we suffered unimaginable hate and discrimination. In school as a child, I was frequently beaten up and when we as a family walked into a grocery store the profanities that were uttered in our direction while entering the store were similar to what the two taxi drivers went through. When we moved into an all Caucasian neighbourhood, a large boulder was thrown through our front living room window. Nothing was done. As a small child just new to the country, I actually believed that Paki was a term of indearment as children and adults kept yelling this name at us whenever we were in public. This taunting has scarred me for life. Although we are Canadian citizens living in this country for over 30 years, we never ever feel like we belong. The racism is more subtle now...never being served at a high end store, no one stopping at crosswalks to let you cross, sales agents always asking if my Caucasian husband and I need separate bills in a restaurant even with our child sitting between us. I am so grateful that there are laws to protect victims of hate crimes. I am also very overwhelmed by the amount of support the two verbally and physically assaulted taxi drivers receivedd. My child will never personally experience the hatred and bullying that I went through. Thank you CPS for pursuing hate crimes and thank you global TV for giving the two taxi drivers a voice and drawing attention to this issue. May no other man, woman or child ever have their self esteem and ability to feel accepted and safe taken away

  • julie - 9 years ago

Absolutely this is a hate crime! I don't know how this ignorance would be considered as anything else. Imagine the outcry if someone if someone from another culture spewed this kind of hate towards a 'white Canadian'. I hope Ms. Bachinsky gets her due reward by losing personal relationships, in court and most of all her karma.

  • Maggie - 9 years ago

This is unbelievable..these people can not be aloud to treat others like this in Canada .that is why my brother and son went to war to make it safe in Canada for all of us ...if they had a problem with the driver they had a choice NOT to get in their car ...but they have no right to abuse anyone and that was ABUSE ...they need to get charge and let the judge deal with them ...
